Mahfud MD stated that in the drafting of the Presidential Regulation concerning TNI Involvement in Handling Terrorism, the government had listened to all stakeholders, had gathered input from various groups, for discussion with the DPR.
“This is the mandate of Law No. 5 of 2018 which regulates the involvement of the TNI in dealing with terrorism. This involvement is regulated in a Presidential Decree, which is then consulted with the DPR, “Mahfud said in an online press conference on Saturday afternoon (8/8/2020).
He further explained that the government has listened to all stakeholders, and conclusions have been drawn, among others; Terrorism is a criminal act, therefore, the spearhead is the Police in the framework of law enforcement.
Then, regarding the involvement of the TNI, the government has also discussed the debate on the definition of acts of terrorism and escalation where involvement is needed. According to him, so far the TNI has also been involved, like in Tinombala and Woyla, that’s all TNI. Polri cannot be alone and there are situations that only the TNI can, such as in places where Polri has no jurisdiction.
If terrorism occurs in the Exclusive Economic Zone (EEZ) or on planes or ships with foreign flags, as well as at embassy offices, the police cannot enter because it is not police territory.
“We have limited it so that there is no excess in implementation, we have invited all those who object to a discussion. We show the mandate of the law and the fact that there are limitations that the police can do. We also show the formulation of the chapters. We listen to all parties, “said Mahfud.
With these considerations, everything has been discussed, has listened to all circles, has been gathered together at the Ministry of Law and Human Rights. All of these will later become material for discussion with the DPR.
